Luigi Mangione Update: Judge Blocks Prosecution Using 5 Pieces of Evidence

A New York judge has dealt a significant setback to prosecutors in the case against Luigi Mangione, ruling that five items seized from his backpack during his detention at a Pennsylvania McDonald’s cannot be used at trial. Manhattan Supreme Court Judge Gregory Carro found that the bag was not firmly in Mangione’s possession when officers searched it, requiring suppression of the magazine, cellphone, passport, wallet and computer chip recovered inside. One item—the journal later logged at police headquarters—remains admissible. Mangione is charged with murdering UnitedHealthcare CEO Brian Thompson during a midtown shooting in December 2024.

NEW YORK, NEW YORK - DECEMBER 16: Luigi Mangione appears for a suppression of evidence hearing in the killing of UnitedHealthcare CEO Brian Thompson in Manhattan Criminal Court on December 16, 2025 in New York City. Mangione's lawyers will argue to have the evidence thrown out because police officers allegedly did not read Mangione his Miranda rights and did not have a proper warrant when they searched his backpack at a Pennsylvania McDonald's last December. He is accused of fatally shooting UnitedHealthcare CEO Brian Thompson and faces state and federal murder charges. (Photo by Seth Wenig-Pool/Getty Images)
